2. Terms of Use and the services offered

Padelist.net may amend these Terms of Use from time to time. Except where changes are required by law or for security reasons, Padelist.net will notify Users of any material changes at least thirty (30) days prior to their entry into force by email or by a prominent notice on the Service. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If a User does not accept the changes, they may terminate their account before the effective date.

Access to and use of the Service is strictly limited to individuals who are at least 18 years old.
Padelist.net reserves the right to request proof of identity at any time in order to verify compliance with this requirement.
Any account created in violation of this rule may be suspended or deleted without prior notice.

3. Description of services provided

Information displayed on the site is provided for information purposes and may be updated. While Padelist.net strives for accuracy, it cannot guarantee that all content is free from errors. Material errors notified to us will be corrected promptly.

By publishing their listing profiles online, users are aware that they can be contacted at any time by email through the contact form of their public profile page by other persons or by Padelist.net to inform them about the community.
However, if they don’t want to be contacted anymore by other padel players or internet users, they can contact Padelist.net to delete their public profile, or, they can modify or delete their profile themselves on their account in the “My listing” section.

Padelist.net reserves the right to suspend or permanently delete a User’s account, without prior notice or compensation, in the following cases:
– breach of these Terms and Conditions,
– behavior contrary to public order or morality,
– publication of illegal, offensive, or infringing content,
– identity theft or fraud.

In case of account deletion, the User’s data will be deleted or archived in accordance with the Privacy Policy.

4. Contractual limitations on the technical data

The site uses JavaScript technology.

The Site cannot be held liable for damage to the User’s equipment resulting from the use of the Site. The Site is designed to work on recent versions of common browsers and devices but cannot guarantee compatibility with obsolete hardware or software. Users are responsible for maintaining adequate security on their devices (updates, antivirus). Padelist.net does not warrant uninterrupted availability of the Service; maintenance or technical incidents may cause temporary interruptions.

5. Intellectual property

Padelist.net and its owner hold the intellectual property rights or the rights to use all public elements available on the site, including text, pictures, graphics, logos and icons. Clubs and courts listed on Padelist.net retain their rights over their pictures and may request removal or modification at any time.

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, regardless of the means or process used, is prohibited without the prior written permission of the owner.

Any unauthorized use of the site or any of its materials will be deemed to constitute an infringement and prosecuted in accordance with L.335-2 articles and following of the Intellectual Property Code.

Images displayed on Padelist.net are used under license or with permission of rights holders. Clubs and courts retain their rights over their pictures and may request removal or modification at any time.

By posting a profile, photo, text or any other content on Padelist.net, the User retains full ownership of their intellectual property rights.
However, the User grants Padelist.net a worldwide, free, non-exclusive, transferable license for the legal duration of copyright protection, allowing Padelist.net to reproduce, represent, host, store, adapt, modify and distribute such content within the framework of the Service.

The User warrants that they hold all necessary rights to publish such content and agrees to indemnify Padelist.net against any claim from third parties.

6. Limitations of Liability

Interactive spaces (possibility to ask questions in the contact area) are available to users. Padelist.net reserves the right to delete, without prior notice, any content listing posted on his website that would contravene the applicable law in France, especially the provisions on data protection. If applicable, Padelist.net reserves the right to question the civil and / or criminal liability of the user, especially in the event of a racist, abusive, defamatory or pornographic message, regardless of the medium used (text, photography …).

Padelist.net may modify or delete any pictures, texts or profiles/pages published by users that are offensive, unlawful, misleading or not aligned with the purpose of the Service.

Padelist.net is not a party to the relationships between Users and provides no guarantee as to the quality, availability, accuracy or honesty of the information shared by Users.
Each User is solely responsible for their statements, publications and interactions.

Padelist.net shall not be held liable for any disputes, damages or injuries arising between Users, whether in the context of online exchanges or physical meetings organized through the platform.

Any User may report to Padelist.net content or behavior that is unlawful or in breach of these Terms and Conditions.
Padelist.net reserves the right to remove any reported or clearly unlawful content, and to suspend or delete the account of the User who published it.

7. Management of personal data

7.1 Legal framework and controller
Padelist.net (the “Controller”) processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable national laws, in particular the French Data Protection Act (Loi Informatique et Libertés) as amended.

7.2 Purposes and legal bases
We process Users’ personal data for the performance of the Service (hosting of profiles, communication between Users), for legal compliance, for security and fraud prevention, and for our legitimate business interests (improving the Service). Where required, processing is based on Users’ consent.

7.3 Categories of data & recipients
Categories of data processed include contact details, profile information, IP and connection data, and content posted by Users. Recipients include service providers (hosting, email, analytics) acting under contract. No sale of personal data occurs.

7.4 Data transfers and safeguards
Data is hosted within the European Union. If personal data is transferred outside the EU/EEA, Padelist.net ensures appropriate safeguards (e.g. Standard Contractual Clauses).

7.5 Retention
Personal data is retained for the duration of account activity plus up to 3 years from last activity, unless longer retention is required for legal reasons or evidentiary purposes.

7.6 Users’ rights
Users have the right of access, rectification, erasure, restriction, data portability, and to object to processing. Users may exercise these rights by contacting [email protected]. A proof of identity may be requested only where necessary to verify the request.
Users may also lodge a complaint with the competent supervisory authority. Padelist.net will respond to such requests within one (1) month, extendable to three (3) months in complex cases, in accordance with GDPR.

7.7 Data security and breach notification
We implement appropriate technical and organisational measures to protect data. In the event of a personal data breach likely to result in a risk to rights and freedoms, Users will be notified in accordance with legal requirements.

 

8. Hypertext links and cookies

The site padelist.net contains a number of hypertext links to other sites. However, the owner of padelist.net does not have the possibility to verify the contents of the sites thus visited, and assumes consequently no responsibility for this fact.

9. Governing Law and Jurisdiction

Any dispute related to site usage padelist.net is subject to French law. It shall have exclusive jurisdiction to the competent courts of Annecy, France.

In accordance with Article L.612-1 of the French Consumer Code, any User qualifying as a consumer has the right to seek free recourse to a consumer mediator with a view to resolving a dispute amicably with Padelist.net.
The contact details of the competent mediator will be provided upon request. Users are also informed of the European Commission’s Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr.
